All of the following conditions apply to all services and software products of PC-Future GmbH, Senkenweg 11, 86972 Schwabniederhofen, or a subcontractor commissioned by it, and apply in addition to the order descriptions which list detailed services and obligations.
Order descriptions may contain deviations from and additions to the following conditions.
For mobile applications (apps), the provisions in Sections 19–26 of these Terms apply additionally.
The performance of the service defined in the respective order description is carried out by PC-Future GmbH during normal working hours, Monday to Thursday from 9:00 to 17:00 and Friday from 9:00 to 15:00 (public holidays excluded).
Offers from the company are generally non-binding unless otherwise agreed. Contracts are concluded through written order confirmation, dispatch of goods, or performance of the service.
All prices are quoted in euros. Statutory VAT is charged additionally. Prices listed on product pages and in the Apple® App Store® for mobile applications are final prices and include statutory VAT.
Invoices are due immediately upon receipt without deduction. For in-app purchases and app downloads, payment processing is handled exclusively through the Apple® App Store®. PC-Future GmbH does not receive any payment data from users.
PC-Future GmbH may determine the shipping method at its own discretion. Risk transfers to the buyer upon handover by the carrier.
The customer has a right of withdrawal within two weeks of receiving the goods. For digital content (app downloads, in-app purchases), the right of withdrawal expires once the user begins executing the contract, provided the user has expressly consented beforehand.
After expiry of the withdrawal period, returns are only accepted in cases of demonstrably incorrect delivery. Cancellation/processing fee: 10% of the invoice amount.
All rights to documentation, drawings, calculations, etc. remain with PC-Future GmbH. Products remain the property of PC-Future GmbH until full payment.
PC-Future GmbH warrants for 6 months from the delivery date that delivered items are free from defects. For software and apps: PC-Future GmbH warrants that the software essentially fulfills the functions described in the product description. No guarantee is given for uninterrupted, error-free operation or complete compatibility with all devices and operating system versions.
PC-Future GmbH may withdraw from the contract in case of payment suspension or insolvency of the customer. Lump-sum compensation: 10% of the purchase price.
PC-Future GmbH is liable for damages in cases of intent or gross negligence. Liability for slight negligence is excluded. PC-Future GmbH is not liable for data loss caused by the user, particularly through improper use, lack of data backup, or independent deletion of data.
The customer must ensure device-specific environmental conditions. All documents accessible during order processing are subject to confidentiality obligations.
Remote access only with the customer's participation (session number). No renewed access after closing the software. Encrypted data transmission.
A minimum of one working hour per individual order is charged. Started hours are rounded up to half or full hours.
We commit to compliance with the GDPR and the German Federal Data Protection Act (BDSG). Privacy policies: Website Privacy Policy | App Privacy Policy (English) | App Privacy Policy (German).
PC-Future GmbH is a limited liability company registered at the Munich District Court under No. 137285.
Place of jurisdiction is Weilheim. German law applies. If individual provisions are invalid, the remaining provisions remain effective.
The following provisions apply additionally to all mobile applications (apps) by PC-Future GmbH, in particular the app "Shopping List + Pantry" / "Einkaufsliste + Vorrat".
The subject of the contract is the provision of the mobile application "Shopping List + Pantry" (hereinafter "App") for download via the Apple® App Store®. The contract is concluded when the user confirms the download or makes an in-app purchase.
The app includes:
Prices listed in the Apple® App Store® are final prices including statutory VAT. The full version and scan packages are one-time purchases, not subscriptions. No recurring costs apply.
The user is granted a simple, non-transferable, non-sublicensable right to use the app on their own Apple® devices. The user is prohibited from:
PC-Future GmbH provides no guarantee of 100% availability of the app or related cloud-based services (particularly AI recipe recognition and barcode databases). The app is generally usable offline.
PC-Future GmbH provides updates for a minimum period of two years after initial download. PC-Future GmbH reserves the right to develop, expand, or modify the app, provided there is a valid reason, no additional costs arise for the user, and the user is clearly informed.
No warranty claim exists if the customer's environment is technically incompatible, the user refused to cooperate in compatibility assessment, the user does not use the current recommended version, or the defect results from user modifications.
PC-Future GmbH is not liable for data loss caused by the user. Users are expressly recommended to regularly back up data using the app's backup function (JSON backup). No liability for the accuracy of third-party database information (allergen data from Open Food Facts).
These Terms are made available via the App Store® product page and at www.pc-future.de/agb-en.html. By downloading the app or making an in-app purchase, the user expressly agrees to these Terms. The privacy policy is available at App Privacy Policy (English) and App Privacy Policy (German).
